JEFFREY EPSTEIN and Defendants. ORDER DENYING MOTION FOR CONTINUANCE OF TRIAL THIS CAUSE comes before the Court on Defendant Jeffrey Epstein's Motion for Continuance of Trial (DE 150). The motion is now fully briefed and is ripe for review. The Court has carefully considered the motion and is otherwise fully advised in the premises. Defendant Jeffrey Epstein seeks a continuance of trial in this civil action, which is currently set for the two week trial period beginning February 22, 2010. Defendant argues that it has not yet taken Plaintiff's deposition, and thus "has essentially been 'boxed-in' and cannot go forward with discovery." (Mot. at 2). Upon consideration, the Court finds Defendant's motion to continue is premature. Discovery in this case is still open until December 30, 2009, and the parties may file a motion to extend the discovery deadline, if necessary. Moreover, there are still two and a half months before the respective February 22, 2010 trial period. Accordingly, it is ORDERED AND ADJUDGED that Defendant's Motion for Continuance of Trial (DE 1 EFTA00723214 Case 9:08-cv-80811-KAM Document 163 Entered on FLSD Docket 12/03/2009 Page 2 of 2 150) is DENIED WITHOUT PREJUDICE.
