Defendant Ghislaine Maxwell has been indicted by a grand jury on charges of conspiracy to entice minors to travel to engage in illegal sex acts, in violation of 18 U.S.C. § 371; enticing a minor to travel to engage in illegal sex acts, in violation of 18 U.S.C. § 2422 and 2; conspiracy to transport minors to participate in illegal sex acts, in violation of 18 U.S.C. § 371; transporting minors to participate in illegal sex acts, in violation of 18 U.S.C. § 2423 and 2; and two charges of perjury, in violation of 18 U.S.C. § 1623.
On July 14, 2020, the Court held a lengthy bail hearing and concluded that the Defendant was a clear risk of flight and that no conditions or combination of conditions would ensure her appearance. It therefore denied bail. On December 8, 2020, the Defendant filed a renewed motion for release on bail pending trial, which was entered into the public docket on December 14, 2020. On December 28, 2020, the Court denied that motion, concluding that the Defendant posed a risk of flight and that no combination of conditions could ensure her appearance. Dkt. Nos. 104, 106.
The Defendant then filed a third motion for release on bail on February 23, 2021. Dkt. No. 160. In this motion, the Defendant attempts to respond to the reasons that the Court denied her bail on December 8, 2020. The Defendant argues that the Court's decision was based on an incorrect understanding of the law and that the Defendant is not a flight risk. The Defendant also argues that the Court failed to consider the Defendant's medical condition and the risk of COVID-19 infection in the jail.
The Court has reviewed the Defendant's motion and the supporting documents. The Court finds that the Defendant's arguments are without merit. The Court's decision to deny bail on December 8, 2020, was based on a thorough review of the evidence and a careful consideration of the Defendant's risk of flight. The Court is not persuaded by the Defendant's arguments that the Court's decision was based on an incorrect understanding of the law or that the Defendant is not a flight risk.
Therefore, the Court denies the Defendant's motion for release on bail. The Defendant will remain in custody pending trial.
