I have reviewed the draft. The language is very strong. I am not sure if we are there yet to issue a letter with
this tone, particularly before the December 15 meeting. We may win the battle with this letter, but this won't be
the entire war. The application for additional construction activities will become very difficult if the letter is
sent in its present form.
The CZM program is Federally funded. They won't like the politicization of the review process that has the
Governor interfering with it. If. is removed, the news media will get involved. Personally I feel Michelle
Baker is in over her head and should be removed, but es removal may bring some unintended public
relations consequences.
I don't believe the Governor will put himself in a position to force his employees to act against the intent of the
law. Understandably some of CZM's requirements are ridiculous and need to be modified, particularly as it
relates to the vehicles on the island. By the same token it is hard to justify the pouring of concrete pads and
driveways without permits as mistakes. CZM will be able to easily establish a pattern of circumventing the
requirements of the CZM, Zoning, and Building Codes to perform construction activities without proper
permits or notifications. This will not look good and will be used as the primary reason for the repressive
restrictions.
Some of the items listed have been already resolved; the moorings, the dump, the fuel tanks, the picnic
benches. I don't see the point of bringing them up again. The flagpole height is vague enough that it could go
either way. I wouldn't push it as them being unreasonable. We can always request it through Land Use &
Appeals. The landscape area is defined as a rectangle because we have not presented a drawing with more
definition. The rectangle is simply a means of limiting the area of change because we haven't .shown a
document that outlines what we want to do. This can be easily changed by modification.
The open space requirement is statutory. This includes landscaped area and driveways. I wouldn't worry so
much about the 40%. There is a recorded endangered species on the island. We have to address that anyway so
I don't think you will be limited by this restriction.
The landing of the helicopter is something we need the Governor for as they are being unreasonable about that.
A copy of the appropriate section of the FAA regulations should cover that.
In conclusion, the Lovango type overall site plan with notes and descriptions of work should cover most of
what we want to do. We need the Governor to get them to recognize that it's ridiculous of them to require a
notification for every hole we dig. By the same token we have to give them enough documentation so they can
answer to the constituents that file complaints all the time.
