Subject: Fwd: Request for comment: ASU determination in incident at Australian conference in
November 2016
Importance: High
If =his is really a letter to the complainant then doesn't this =iolate confidentiality? I assume he really meant
respondent =ere, and misstyped.. but
anyway, should I =rite to the Provost with these two letters and ask how the =niversity could do this? Who did it? and
point out that it =ow biases
the investigation..? This =s pretty serious breach of confidentiality.. a gross violation of my =ights.. What to do now?

Dear =rof Krauss,
We understand that Arizona State =niversity has found that you were in breach of its policy ACD 401(Prohibition
Against Discrimination, Harassment and Retaliation) over the incident on November 26, 2016.
A letter sent to the =omplainant on July 31, 2016, by University Provost Mark Searle, states:
"I accept the =inding of OEI (Office of Equity and Inclusion) that Respondent did grab the right breast of the
woman in the photograph based on the consistent information provided by the female involved in the incident, two
quests at the gala reception and dinner who actually witnessed the incident as it occurred from a distance of 20 feet and
10 to 15 feet, and two other guests who did not witness the incident but who were individually told about the incident."
With regard to your explanation =hat your raised your hand to shield your eyes from camera flash, the latter
states "I do not find that explanation persuasive against the weight of the evidence from the other witness statements."

The letter states that ASU provided funding for =our attendance at the meeting concerned though an in-country
airfare and per diem reimbursements. It does on to say that your conduct "created an offensive environment for
academic pursuits by the unnamed female attendee as well as other conference attendees."
Ifrconcludes: "Responsive action will be taken to prevent a recurrence of this conduct."
Furthermore, the =omplainant has told us that she requests an apology from you, and for you to withdraw your
comments, made to BuzzFeed News and in your 9-page statement, that her original complaint was "fabricated with
malicious intent."
If you have any comments on =hese developments, please do contact me by email or phone.
Sincerely,
Peter Aldhous
