ORDER DENYING L.M.'S EMERGENCY MOTION
AND
AGREED ORDER ON USE OF VIDEO DEPOSITION OF L.M. AND EPSTEIN
THIS CAUSE came before the Court on Emergency Motion for Enforcement of
Order Granting Leave to Proceed Anonymously through Sealing of her Deposition, and
the Court having been advised by counsel, it is hereby
ORDERED and ADJUDGED:
1. Motion to seal is denied. -
2. However, the parties have agreed that neither L.M. nor Jeffrey Epstein's
video depositions (i.e. the actual video vs. the written transcript) shall be
provided to the press or any person who is not their attorneys (or a member
of their staff), the parties themselves or their experts nor shall the video
depositions be filed with the clerk or in the court file without a reasonable
legal purpose, nor shall any party or their legal representative who is in
attendance at the Plaintiff or Defendant's video depositions (who may obtain..,
a copy of same) violate this order.
3. Should either LM or Jeffrey Epstein, or their attorneys, determine that the
video depositions need to be filed, they shall provide a10-day notice by fax to
opposing counsel who shall have the opportunity to object by filing a
protective order. The parties shall wait until the court has ruled on such a
motion before filing the video deposition, if allowed. The parties may request
an in-camera viewing, if appropriate.
4. Sanctions shall be granted for a violation of this order.
