As promised, attached please find materials for the October 14 mock bail arguments, including:
1. The "Doe" complaint and pretrial services report that will serve as the factual basis for your argument
2. Sample bail letters, argument transcripts and decisions from US v. Epstein, US v. Maxwell and US v. Ng
3. Bail argument cheat sheets
Below are the assignments for the two rounds of mock argument. You will work in teams of two to develop your
argument and moot it (e.g. and are a Government team and and are a Defense team for
the first mock argument), but only one member of each Government and Defense team will argue before Judge Moses
(e.g., or against or ). Each team can decide who argues, and whoever does not argue
live on October 14 will argue during the mock sentencing on November 4, 2020. Let me know if you have questions.
— since we have an odd number, you can prep with the Argument 1 defense team or with one of your AUSA
supervisors, but you should definitely team up with someone else to work through this, as we typically would on a case
team.
